Annual Privacy Policy Notification

As our customer, you provide us with important information about yourself. We believe it is our responsibility to safeguard your confidential personal and financial information. While some financial institutions share account owner information with other businesses, we are committed to keeping it confidential.

We have developed the following privacy policy to ensure you the confidentiality you deserve. You have our promise that we will adhere to these guidelines. It is our pledge to you.

NOTICE OF YOUR FINANCIAL PRIVACY RIGHTS

We, our, and us used in this notice, mean NewDominion Bank.
This is our privacy notice for our customers. When we use the words "you" and "your" we mean the following types of customers:

  • Our consumer customers who have a continuing relationship by purchasing or holding financial products or services such as a(n):
    • Deposit Account
    • Loan Account
    • Credit Card Account
    • Retail installment contract we hold and service
  • All IRA accounts for which we act as custodian
  • Former customers

We will tell you the sources of the information we collect about you. We will tell you what measures we take to secure that information. We first define some terms.

Non-public personal information means information about you that we collect in connection with providing a financial product or service to you. Non-public personal information does not include information that is available from public sources, such as telephone directories or government records. Hereafter, we will use the term “information” to mean non-public personal information as defined in this section.

An affiliate is a company we own or control, a company that owns or controls us, or a company that is controlled by the same company that owns or controls us. Ownership does not mean complete ownership, but means owning enough to have control.

A non affiliated third party is a person we do not employ or a company that is not an affiliate of ours. This is also known as nonaffiliated third party, or simply, an “other party.”

THE INFORMATION WE COLLECT

We collect information about you from the following sources:

  • Information about your transactions with other parties
  • Information from a consumer reporting agency
  • Information we receive as a result of verifying customer information

INFORMATION WE SHARE WITH NON AFFILATED THIRD PARTIES PERMITTED BY LAW

We are permitted under the privacy law to share information we collect with certain third parties that are necessary to provide a requested product or service or when we have an agreement with a provider of specialized financial services to jointly offer products that enhance our ability to serve your needs.  For example, we offer check printing and bill payment under Servicing Arrangements.  The companies that we engage for these services are reputable and are under contract with us to maintain your privacy and the confidentiality of your non-public personal information.  Third parties may also include credit reporting agencies to whom we report information about your transactions with us and as permitted by law to third parties in response to subpoena, court order or to other appropriately documented authority.  Also, you can authorize us to release your information to third parties on your behalf.

HOW TO TELL US NOT TO SHARE THIS INFORMATION WITH NON AFFILIATED THIRD PARTIES

If you ask us not to share information with Non Affiliated Third Parties with which we have chosen to assist us with marketing efforts you may miss learning of financial products and services offered by these companies that might be of benefit to you. If you prefer that we not share application information and credit-related information obtained from you and others, you may direct us not to share (opt out) by:

  • Calling us toll free at 1-800-592-6248
  • Coming into one of our offices at your convenience

We will process your request as soon as we reasonably can. Once you have notified us of your privacy preferences no further action is required on your part.

NOTE: Your opt out only covers application information and credit-related information obtained from you and others that we might otherwise share with nonaffiliated third parties. We may continue to share other information about you with NewDominion Bank affiliates as permitted by law, such as information about your transactions with us and certain identifying information, including name, address, telephone number, and social security number. You will continue to receive product messages via your statement(s), as well as telephone and mail offers from NewDominion Bank.

THE CONFIDENTIALITY, SECURITY, AND INTEGRITY OF YOUR INFORMATION

We restrict access to information about you to those employees who need to know that information to provide products or services to you. We maintain physical, electronic, and procedural safeguards to protect this information. With the rapid expansion of technological capability in our industry and in our institution, NewDominion Bank is committed to maintaining and expanding effective systems to facilitate the convenient delivery of services regardless of the method of delivery. We value our customers and recognize the importance of your trust and confidence in us. Information gathered via the Internet, when established, or other electronic means will be used only for appropriate purposes such as evaluation of our web pages’ effectiveness, designing new products or services for the benefit of our customers or estimating system capacity needed to conveniently service our customers.

INFORMATION ACCURACY

Our corporate family continually strives to maintain complete and accurate information about you and your accounts. If you ever believe that our information is inaccurate or incomplete, please notify us immediately. We will review your concerns and correct any inaccuracies. Under the Fair Credit Reporting Act, you have the right to notify us if you believe we have reported inaccurate information about your account to any Consumer Reporting Agency. Please submit your request for correction in writing and include your full name, current address, social security number, account number, telephone number, and the information you believe is inaccurate. We have the same policy about disclosing information about former customers as we do about current customers.

KEEPING UP TO DATE WITH OUR PRIVACY POLICY

As required by law, NewDominion Bank will provide notice of our Privacy Policy annually, as long as you maintain an ongoing relationship with us. We may make changes to this policy at any time and will inform you of changes, as required by law.
